     Welcome to the Legacy Custom Memorial Vaults ("LCMV") website.  PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE.  All users of this website agree that access to and use of this site are subject to the following terms and conditions and other applicable laws.  If you do not agree to these terms and conditions, please do not use this site.  LCMV reserves the right, at its sole discretion, to change, alter, add, remove, or modify any and/or all portions of these terms and conditions, or any other part of the website, at any time without any prior notice.  Please, check these terms and conditions, and other LCMV rules and disclosures periodically for updates and changes.  Your subsequent or continued use of LCMV's website subsequent to the posting of any changes to these or other terms will mean you accept those changes accordingly.

Warranty Disclaimer

     We pride ourselves in providing gorgeous, well-made, handcrafted and unique cremation urns/vaults, accompanying accessories, and other products to you.  Our cremation urns/vaults, accessories, and other products are warranted to be free from major defects or workmanship upon your initial receipt.  (See our Return Policy for details)  However, LCMV does not warranty imperfections in the colors, patterns, or any other characteristic of the stone as these are often naturally occurring imperfections.  These variations do not constitute a defect in any way whatsoever in the quality or appearance of the cremation urn/vault, accessories, or other product, and customers purchasing such items agree and accept such variations.  (See our Disclaimer for details.)  LCMV disclaims all warranties, express or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose and non-infringement regarding the cremation urns, cremation vaults, accessories, or other products.  LCMV does not warrant nor represent that the functions pertaining to this site will be uninterrupted or free of errors.  Nor does LCMV warrant nor represent that any defects will be corrected  or that the site or the server running the site are free of viruses or other harmful items.  LCMV does not warranty nor represent the use of items in this site for their timeliness, usefulness, reliability, correctness, adequacy, accuracy or any other functions.  Some states do not permit limitations or exclusions on warranties, and as such, the above limitations may not apply to you.

Limitation of Liability

     LCMV shall not be liable for any special or consequential damages resulting from the use of, or the inability to use, the cremation urns/vaults, accessories, or other products on this site or the performance of the products, even if LCMV has been advised of the possibility of such damages.  LCMV is unable to accept the liability for any conduct, acts, or omissions occurring at this web site or any losses you may incur as a result of visiting the site.  In no event will LCMV be liable to you for any consequential, indirect, incidental, or special damages, including without limitation any lost profits, lost revenues, costs of replacing goods, lost or damaged data arising from the use or inability to use this site, damages resulting from reliance on or use of the site's information, regardless of any such notifications from you, or any third-party claims.  Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Indemnification

     You agree to indemnify, defend, and hold harmless LCMV, its owners, members, shareholders, partners, officers, directors, employees, and agents ("LCMV Family")  from and against any and all losses, expenses, damages, and costs, whatsoever including reasonable attorney(s)' fees, resulting from any violation of the terms and conditions contained herein or any activity related to your account with LCMV (including negligence or misconduct) by you or any person accessing this site using your internet resources.

Term - Termination

     These terms and conditions are applicable to you upon your accessing this site and/or completing the registration or shopping process.  These terms and conditions, or any part contained therein, may be terminated by you or LCMV without notice at any time, for any reason whatsoever.  Simply discontinue use of this site and destroy all materials, copies, installations, and documentation obtained from this site.  Failure to comply with these instructions could subject you to penalties, charges, fees, and fines, including potential litigation.  The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous, shall survive any termination.

Typographical Errors

     In the event that LCMV or a supplier product, (such as but not limited to cremation urns/vaults, accessories, or other products), is mistakenly listed at an incorrect price, LCMV reserves the right to refuse or cancel any orders placed for product listed at the incorrect price.  LCMV reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.  If your credit card has already been charged for the purchase and your order is cancelled, LCMV shall issue a credit to your credit card account in the amount of the incorrect price.

Order Acceptance - Confirmation

     Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.  LCMV reserves the right at any time after receipt of your order to accept or decline your order for any reason.  Be sure to verify that your order is correct in the shopping cart prior to making payment.

Jurisdiction

     Your use of this site shall be governed in all respects by the laws of the State of Texas, U.S.A.  Specifically, you agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to LCMV's web site (including but not limited to the purchase of LCMV products) shall be in the State or Federal courts located in Texarkana, Texas.  LCMV's failure to insist upon or enforce strict performance of any provision of these terms and conditions or any other rules, policies, or notifications contained herein shall not be construed as a waiver of any provision or right.  Neither the trade practices nor the course of conduct between the parties shall act to modify any of these terms and conditions.  LCMV retains the right to assign its rights and duties contained in this agreement to any party at any time whatsoever without notice to you.

     The information and materials on this site are presented solely for the purpose of promoting the products, (cremation urns/vaults, accessories, and other products), for sale on the LCMV web site.  Visitors to this site access it on their own choice and initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

     LCMV may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable methods to the address you have provided to LCMV.

Use of Site

     Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly prohibited.  Impersonation of others, including an LCMV owner, partner, member, shareholder, director, employee, agent, host, or representative, as well as other members or visitors on this site is strictly prohibited.  You may not upload to, distribute, or otherwise publish through this site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, slanderous, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.  You may not upload commercial content on this site or use this site to solicit others to join or become members of any other commercial online service or other organization.

Payment Methods

     There is no additional charge for using a credit card or Paypal.  LCMV is a secure site, but if you prefer more personal customer service, please contact us at Support@memorialvaults.com and provide your phone number.  A customer care specialist will contact you and take your order over the phone.  We also accept checks and money orders.  Your order will ship after the payment clears.

Pricing, Products, and Policies

     Pricing, policies, and shipping charges applicable to the purchase of cremation urns/vaults, accessories, and other products are as set forth on this site, (exceptions may apply), and are incorporated into these terms and conditions by reference.  All costs and fees are quoted in U.S. dollars and do not include sales taxes (if applicable).  We may in our sole discretion add, delete, or change some or all of the prices of our products, services, or shipping charges at any time without any notice whatsoever.  Sales taxes will automatically be added to orders for Texas residents.

Shipping Policies

     LCMV prices include regular ground shipping ("Free Shipping") on orders over $994.00.  LCMV only ships to a destination within the 48 contiguous United States.  Orders requiring special delivery may incur additional charges.  It is the customer's responsibility to track their package and notify us in a timely manner if there are any issues regarding delivery.  (See Return Policy for details.)  Be sure to verify your order and the address you are providing.

     In the event that an order is cancelled after an item has shipped - but before the item has been delivered - the Customer will be charged for the actual shipping charges to AND any return shipping costs, even if the order qualified for "Free Shipping".  In some instances, Customer may be responsible for restocking fees, as well.
